Terms of Use
These Terms govern your use of vplazhits.com. The site is operated by VPLAZ Hitting (public brand: VPLAZ.HITS), based in Quebec, Canada. Contact: hello@vplazhits.com.
VPLAZ.HITS is a remote coaching business that works with athletes around the world. Hybrid programs also include in-person sessions in the Montréal region.
1. Acceptance
By using the site, you accept these Terms. If you do not accept them, do not use the site. Nothing in these Terms takes away a right that the law of Quebec, or the mandatory law of the place where you live, gives you as a consumer.
2. The site is information, not a coaching contract
The site describes our coaching and lets you apply. Applying does not guarantee acceptance, reserve a spot or commit you or us to a paid program.
A paid program only starts under a separate written coaching contract that sets out the services, price, payment schedule, start date, duration and cancellation rights. If these Terms and your coaching contract differ, the coaching contract governs the program, and mandatory law governs both.
3. Who can apply
Our programs are for baseball and softball athletes 14 and older. If the athlete is under 18, a parent or legal guardian must be involved in the application and is the contracting customer for any paid program.
Give accurate information, and only submit someone else's information if you are authorized to. We may ask for proof of age, identity or authority.
4. Programs, payments and cancellation
Prices, taxes, payment schedules and what each program includes are confirmed in writing before you commit. Payments are processed by Stripe.
Consumers in Quebec: where the Consumer Protection Act's rules on contracts for instruction or training apply, you may cancel your coaching contract at any time, at your discretion, by sending us the cancellation form attached to your contract or any other written notice (an email to hello@vplazhits.com is enough).
- If you cancel before we start coaching, you owe nothing.
- If you cancel after we start, you only pay for the services you received, plus, at most, a penalty equal to $50 or 10% of the price of the services not received, whichever is less.
- We refund any amount owed to you within 10 days of the cancellation.
Athletes outside Quebec: the cancellation and refund terms are in your coaching contract, and any mandatory consumer protection of the place where you live still applies.
5. What coaching is, and is not
VPLAZ.HITS provides hitting coaching, training education, video feedback, planning and related performance support, as described in your program.
We do not provide medical diagnosis or treatment, physiotherapy, psychotherapy, psychological assessment, nutrition therapy or emergency services. Mental-performance coaching is educational coaching, not psychology or psychotherapy. Information on the site is general and cannot account for an athlete's individual condition. For pain, injury, illness, mental-health concerns or return-to-play decisions, see a qualified health professional. In an emergency, call 911 or your local emergency number.
6. Safety
Baseball, softball and physical training carry risks, including being hit by a ball or bat, falls, muscle or joint injury and aggravation of an existing condition. Remote training happens in a space you choose and control. Athletes and parents must tell the coach about relevant limitations, use a safe space and suitable equipment, follow instructions, and stop any activity that causes pain or unsafe symptoms.
Nothing in these Terms excludes or limits our liability where the law does not allow it, including for bodily or moral injury, or for intentional or gross fault.
7. Results vary
Athlete stories, statistics, videos and testimonials on the site describe the past experience of specific athletes. They are not a promise or a typical result. Progress depends on the athlete's starting point, age, health, consistency, recovery, competition level, how measurements are taken and other factors we do not control. We do not promise any specific velocity, strength, statistics, playing time, team selection, scholarship or recruiting outcome, and we do not control any of those decisions.
Testimonials are published with the person's written approval. If someone received free or discounted coaching or another benefit related to a testimonial, we say so next to it.
8. Applications and messages
We may accept, decline, place on hold or ask for more information about an application, based on program fit and capacity. Agreeing to be contacted about your application or program is not consent to promotional messages. Promotional consent is separate, optional and can be withdrawn at any time.
9. Acceptable use
Use the site lawfully and for personal, non-commercial purposes. Do not:
- interfere with the site's operation or security, or try to access it without authorization;
- introduce malicious code;
- copy or scrape the site at scale without written permission;
- impersonate someone or submit false, unlawful, infringing or harmful content;
- suggest an affiliation with VPLAZ.HITS that does not exist.
We may restrict access when reasonably necessary to protect the site, its users or our rights.
10. Content you send us
You keep ownership of the videos, photos, statistics and text you send us. You allow us to store, copy, transmit and process them only as needed for the reason you sent them, such as reviewing your application or coaching you.
Sending an application or a coaching video does not give us the right to use it in promotion. Any public, testimonial or advertising use requires your separate written authorization (and a parent or guardian's for an athlete under 18).
You confirm you have the right to send the content and that it does not violate anyone's privacy, image, copyright or other rights.
11. Our content
The site, the VPLAZ.HITS brand, the Body Awareness Hitting System Standard, and our text, graphics, videos and training materials belong to VPLAZ.HITS or its licensors and are protected by intellectual property law. Do not reproduce, adapt, sell, publish or commercially use them without written permission. You may share a normal link to a public page.
12. Other services and links
The site links to or embeds services run by others, such as Jotform, YouTube, Instagram, Stripe, SignWell, Calendly and Trainerize. We do not control their sites, terms or availability. Their own terms and privacy policies apply when you use them.
13. Availability and accuracy
We try to keep the site accurate and available, but errors, interruptions and outdated content can happen, and we may update the site at any time. A change to the public site does not change a coaching contract you already signed. Your legal warranties as a consumer are not affected.
14. Responsibility
Each party is responsible for loss caused by its own fault and for obligations imposed by law or by a signed contract. Where the law allows, VPLAZ.HITS is not responsible for indirect loss caused only by a user's misuse of the public site or by a third party we do not control. No clause excludes a right, remedy or warranty that the law does not allow to be excluded.
15. Privacy
Our Privacy Policy explains how we handle personal information.
16. Changes
We may update these Terms for the future. The new date will appear above, and we will give notice of important changes. An update does not change a coaching contract already signed.
17. Governing law and disputes
These Terms are governed by the laws of Quebec and the federal laws of Canada that apply there. If you are a consumer, you keep the protection of the mandatory law of the place where you live and the right to go to the courts that law allows. Nothing here requires a consumer to go to arbitration or to give up a class action.

18. Language
These Terms are available in French and English. Both versions have the same meaning. If they differ, the French version prevails in Quebec.
